The law says the following:
"Payment of wages up to the 5th business day of the month following the month in which the salary is due is not subject to monetary correction. If this deadline is exceeded, the monetary correction index for the month following the month in which the services were provided will apply, starting on the 1st." (TST Summary 381, or normative precedent 72).
In other words, if you do not receive your salary by the fifth working day of the month, you are entitled to receive it with a correction applied to the amount.
When is Saturday not a working day?
In some situations, Saturday is not considered a working day:
- When a holiday falls on a Saturday.
- When you have to make a bill payment on Saturday, you must pay it on the next business day without incurring interest.
- In banking operations.
- For INSS payments, since, for the government, salaries are paid from Monday to Friday.
Therefore, it is important to understand each situation so that you know whether Saturday will be considered a working day or not.
From what time can the payment be credited to the account?
The time it takes for your money to arrive in your bank account depends on several factors, including the bank you're receiving it from and how your payment is processed.
For those who receive payments from private companies, the payment will be credited to your account depending on when the company transfers the money. If the transfer is made before 4 p.m., it may be credited the same day. If not, it may not be credited until the next business day.
However, it is worth remembering that it depends on the type of operation used to pay the bill (TED, DOC, TEF or PIX).
When it comes to receiving INSS funds, the salary deposits into the account between 6 and 8 a.m. This is the base time banks close transactions, making the funds available to customers.
In the case of Caixa Econômica Federal, the money is generally available at 6 am.
Can payment on the 5th business day be made after the 7th?

It is worth remembering that if you receive payment through INSS, in months where the fifth business day falls on a Saturday, you will receive payment on the next business day of the month.
How many days can the company delay paying salaries?
Article 459 of the CLT states: “1. When payment has been stipulated per month, it must be made no later than the fifth business day of the month following the due date.” In other words, you are legally entitled to receive your payment by the fifth business day of the month.
If this does not happen, you also have the right to receive your salary with adjustments for the delay.
And, according to the law, late payment of wages is considered a serious offense against the company. Therefore, the company must make payment by the fifth business day of the month.
If there are delays in payment, the employee has the right to take legal action against the company.
When the due date is on Saturday, can you pay on Monday?
