MEI Truck Driver: Does it exist?

Bill 188/2021 was recently approved, aiming to help truck drivers formalize their status as Individual Microentrepreneurs (MEI) and, consequently, guarantee their rights and benefits with the INSS (National Institute of Social Security). The bill was authored by Senator Jorginho Mello (PL-SC) in partnership with Sebrae (Brazilian Social Security Institute).

CGSN Resolution Project No. 165 was created to offer a more complete and simplified solution for truck drivers who, with the current revenue limit of R$ 81 thousand, found it difficult to have their expenses and earnings covered by this amount.

With the approval of the project, truck drivers will have access to a series of benefits and advantages, being able to formalize themselves as MEI and count on the rights and guarantees provided by law.

How does MEI work for truck drivers?

The MEI Truck Driver program operates similarly to the traditional MEI, but with some differences in revenue and tax amounts. By registering as an Individual Microentrepreneur, truck drivers receive a CNPJ (Brazilian Corporate Taxpayer Registry) and must pay a simplified tax every month.

This single monthly tax already includes all taxes required for the activity, eliminating the need for additional taxes for legal entities. The payment slip must be issued monthly on the IRS portal.

Furthermore, the tax payment serves as a contribution towards retirement and also entitles you to important benefits, such as sickness benefit and maternity benefit.

The MEI Truck Driver has an annual revenue limit of R$1,400,000, higher than the traditional MEI. Registration can be completed online through the government's Entrepreneur Portal.

Furthermore, as an MEI, truck drivers have all the rights of other microentrepreneurs, such as issuing invoices and having an employee. However, they cannot be partners in another company.

MEI for Truck Drivers: what are the advantages?

  • INSS collection is done through DAS, where the rate is 12%, different from the 20% for those who do not have MEI.
  • It has all the labor benefits, such as retirement, sickness benefits, maternity benefits, accident benefits, etc.
  • It allows the issuance of an invoice, which is advantageous, as it eliminates the need for a freight company to act as an intermediary for the customer.
  • Access to credit and exclusive discounts for MEIs.
  • Discounts on cars, which can reach 30%.
  • Affordable health plan with CNPJ.

Is it more advantageous to become a MEI for truck drivers than a regular MEI? Why?

If you're a truck driver, it's definitely worth having a MEI (Individual Microentrepreneur) specific to your category. All the questions are focused on the advantages this type of registration offers truck drivers, who will benefit from increased revenue generation.

So, if you have a turnover that exceeds the value of a normal MEI and work in the transportation category, it is worth being a MEI truck driver.

One of the main differences between MEI and MEI Truck Driver is the annual revenue limit and tax amount. While MEI's annual revenue is capped at R$$ 81,000, MEI Truck Driver's revenue can reach up to R$$ 251,600.

Furthermore, the tax amount also varies: for service providers and micro-entrepreneurs in industry and commerce, the MEI tax is up to R$ 71 per month, while the MEI Truck Driver pays from R$ 151.44 per month.

What are the advantages of MEI for truck drivers?

As a freelancer, it is often difficult to get work in large companies, as most require the driver to issue an invoice.

This can limit the number of jobs available and, consequently, impact salary. To obtain an invoice, the self-employed worker may need to hire a freight company.

In practical terms, the salary can vary between R$ 3,720.00 and R$ 5,011.00, depending on the hours worked and the delivery made.

However, by becoming a MEI truck driver and having the ability to issue invoices, job opportunities expand and salaries can increase significantly. On average, a MEI truck driver can earn a base salary of R$6,000 to R$7,000 per month.

This is one of the advantages of formalizing the activity and becoming an Individual Microentrepreneur.

How to open a MEI for truck drivers?

To become a MEI truck driver, you must first understand that the entrepreneur portal has created two tables: Table A for regular MEIs and Table B for MEI truck drivers. The categories in Table B are:

  • CNAE 4930-2/01 – Municipal cargo transporters (non-hazardous cargo);
  • CNAE 4930-2/02 – Truck drivers of non-hazardous cargo;
  • CNAE 4930-2/03 – Independent Cargo Transporter – Dangerous Products;
  • CNAE 4930-2/04 – Moving companies.

If you wish to register, please have your documents at hand: CPF, CNH or RG, Proof of residence, IR Declaration, if you have made it in the last 2 years.

Then, simply access the MEI page on the Entrepreneur Portal.

Then, simply click on the “formalize” card and enter your business details, such as the type of occupation in Table B, form of operation and address.

What could be the disadvantages of MEI for truck drivers?

There are some details you should keep in mind when registering as a MEI Truck Driver that may be disadvantageous to you:

  • Although MEI truck drivers have the advantage of being able to generate higher revenues than other types of MEIs, the DAS amount is much higher. Therefore, you should organize your accounts to be able to make this payment.
  • Even though the limit is higher, there is a revenue cap of R$251,600.00 per year. Therefore, you will need to calculate your shipping costs to ensure they do not exceed this amount.

If you have a steady job as a truck driver and want to secure better contracts, with the possibility of issuing your own invoices and being sure that you will take better advantage of the benefits of formalization, it is certainly worth becoming a MEI Truck Driver.
